Patrico Vizuette v. D.C. Group, Inc., d/b/a Unique Settings of New York, and Ozan Ekmel Anda, Case No. 15-cv-04441

On July 29, 2015, Lead Plaintiff Patrico Vizuette, on behalf of himself and those similarly situated, filed a class and collective action lawsuit in the United States District Court – Eastern District of New York vs. D.C. Group, Inc. d/b/a Unique Settings of New York, and Ozan Ekmel Anda. The complaint alleges as follows: Mr. Vizuette worked for Defendants from July 6, 2008 until on or around November 18, 2014. During his employment, Plaintiff worked between 45 and 52.5 hours each week with only a half hour break for lunch. Defendants failed to pay Plaintiff any rate of pay or the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that they worked per week over forty hours as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Plaintiffs with accurate wage statements on each payday, or with proper wage notices on an annual basis as required by the New York Labor Law.
