Rafique v. Isham Broadway Pharmacy, Inc., and Satyanarayana Nekkanti, individually Case No.: 1:18-cv-02801
On March 30, 2018, Lead Plaintiff Mr. Rafique, filed a civil action lawsuit in United States District Court – Southern District of New York against Isham Broadway Pharmacy, Inc. and Satyanarayana Nekkanti. The complaint alleges as follows:
Plaintiff began working for Defendants – a Manhattan pharmacy and its owner — as a sales clerk from 1989 until his termination on January 15, 2018. For at least the six-year period pre-dating this action’s commencement through his last day of work, Mr. Rafique was required to work approximately sixty-two hours each week. Regardless of the number of hours that Plaintiff actually worked, Defendants paid Plaintiff a flat weekly salary of $635.00, which was intended to and did only cover the first forty hours worked each week. Thus, Defendants violated the FLSA and NYLL by failing to compensate Mr. Rafique at any rate of pay for any hours that he worked in excess of forty each week. Further transgressing the law, Defendants neglected to provide Plaintiff with wage statements that accurately listed his actual hours worked for each week, his straight rate of pay, and his overtime rate of pay for all hours worked.
