Israel Martinez v. M. & A. Interior Painting & Tiling, Inc., et al., Case No. 14-cv-8047

On October 5, 2014, Lead Plaintiff Israel Martinez on behalf of himself and those similarly situated filed a collective action lawsuit in United States District Court – Southern District of New York vs. M. & A. Interior Painting & Tiling Inc. and individuals Muneshwar Singh and Shafi “Doe”. Mr. Martinez worked for Defendants as a painter from in or around April 2010 until February 7, 2014. Throughout his employment, Defendants consistently required Mr. Martinez to work over forty hours per week but failed to pay him overtime compensation at the statutorily-required overtime rate of pay for each hour that he worked per week that was in excess of forty total hours, as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Mr. Martinez with accurate wage statements on each payday as required by the New York Labor Law.
