On December 30, 2014, Plaintiffs Jayson Cortes and Luis Jose Ventura on behalf of himself and those similarly situated filed a collective action lawsuit in United States District Court – Eastern District of New York vs. Warb Corporation d/b/a La Vega Grocery and Jose Rosado. Mr. Cortes is a current employee of Defendant, and he has worked as a cashier and stock person since September 2010. He alleges he works six days per week, in shifts ranging from eleven-to-sixteen hours per day. Mr. Ventura formerly worked for Defendants as a cleaner, stock person and sandwich maker from January 11 through April 2014. He alleges that he worked six days per week in shifts ranging from eleven-to-fourteen hours per day for a total of seventy hours per week. However, Defendants failed to pay Mr. Cortes and Mr. Ventura at any rate of pay or the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that they worked per week over forty hours per week as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Mr. Cortes and Mr. Ventura with accurate wage statements on each payday as required by the New York Labor Law.
