Norberto Mercado v. Sami’s Service Station, Inc. et al., Case No. 14-cv-3400
On May 6, 2014, Lead Plaintiff Norberto Mercado on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – Southern District of New York vs. Sami’s Service Station and Sami Radwan. Mr. Mercado alleges he worked as customer service representative and gas station attendant at Defendant’s gas station six days per week from 1:00 p.m. – 11:00 p.m. for a total of sixty hours per week. Defendants paid him in cash in the amount of $11.25 for his first forty hours worked, but they did not pay minimum or overtime wages for hours he worked over forty hours per week, provide him an uninterrupted lunch break or provide him with any accurate wage statements in violation of New York Labor Law, New York Compensation Codes Rules and Regulations and the Federal Fair Labor Standards Act.
