On November 11, 2014, Lead Plaintiff Fortino Callejas on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – Eastern District of New York vs. 427 Kings Highway, Inc. d/b/a Peppino’s Brick Oven Pizza & Restaurant and Joseph Mancino. Mr. Callejas worked for Defendants as a cook from January 2011 through September 2014. He alleges that he worked about six days a week in shifts of ten-and-one half hours to thirteen hours per day for approximately sixty-three to seventy-eight hours per week. In addition, Defendants failed to furnish Mr. Callejas with accurate wage statements on each payday as required by the New York Labor Law.
