On November 18, 2014, Lead Plaintiff Nicola Williams on behalf of herself and those similarly situated filed a collective action lawsuit in United States District Court – Southern District of New York vs. The Bethel Springvale Nursing Home, Inc. Ms. Williams worked for Defendants as a Registered Nurse from March 2012 through September 2014. She alleges that she worked between forty-one and one-quarter and fifty-five hours per week throughout her employment. However, on most occasions, Defendants failed to pay Ms. Williams the proper minimum wage, or the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that she worked per week over forty hours per week as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Ms. Williams with accurate wage statements on each payday as required by the New York Labor Law.
