Pete Colon v. Triboro Plumbing and Heating Corp. and Michael Passalacqua, Case No. 14-cv-06632
On November 11, 2014, Lead Plaintiff Pete Colon on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – Eastern District of New York vs. Triboro Plumbing and Heating Corp. and Michael Passalacqua. Mr. Colon worked as a laborer for Defendants from March 2013 through December 2013. He alleges that he worked between fifty to eighty hours per week. However, Defendants failed to pay Mr. Callejas any rate of pay or the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that he worked per week over forty hours per week as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Mr. Colon with accurate wage statements on each payday as required by the New York Labor Law.
