Abraham and Sylvester v. Promise Home Care Agency, Inc.; Case No.:18-cv-04502

$1,100,000.00 – Wage & Hour Violations – Firm represented a collective of employees and former employees against Promise Home Care Agency, Inc a home health care agency for unpaid, overtime wages in violation of the Fair Labor Standards Act and New York Labor law  (prior post upon action commencement located here:  https://www.employmentlawyernewyork.com/news/latest/cert-case-no-18-cv-04502.html.  Generally, the Plaintiffs contended that the Company subjected them to working over twelve hour shifts and whenever they exceeded 40 hours a week, the agency only paid them straight time.  Additionally, Plaintiffs argued that Defendants failed to provide Plaintiffs with accurate wage statements on each payday as the New York Labor Law requires.  After litigating the matter and engaging in mediation, the Firm negotiated a settlement of $1,100,000.00.  Michael J. Borrelli, Alexander T. Coleman and Michael R. Minkoff handled the matter for the Firm.
