New Collective Action filed in the District of New Jersey
Leonardo Mejia and Ricardo Garcia v. Blue Bay Enterprises LLC, and Michael Krikorian, Case No: 16-CV-00678
On February 8, 2016, Lead Plaintiffs Leonardo Mejia and Ricardo Garcia on behalf of themselves and those similarly situated filed a class and collective action lawsuit in United States District Court – District of New Jersey vs. Blue Bay Enterprises, LLC and Michael Kirkorian. Mr. Mejia and Mr. Garcia worked for Defendants, a restaurant and its owner, as kitchen staff members collectively from October 15, 2006 through November 14, 2014. They allege that they worked between sixty and seventy-three hours per week throughout their employment. However, Defendants failed to pay Mr. Mejia and Mr. Garcia the proper minimum wage or any rate of pay or the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that they worked per week over forty hours per week as the New Jersey Wage and Hour Law and the Federal Fair Labor Standards Act require. In addition, Defendants retaliated against Mr. Mejia and Mr. Garcia for filing complaints against Defendants in violation of the Federal Fair Labor Standards Act and the New Jersey Conscientious Employee Protection Act. Defendants acts of retaliation were also in violation of law.
