On August 12, 2014, Lead Plaintiff Maria Morales on behalf of herself and those similarly situated filed a class and collective action lawsuit in United States District Court – Eastern District of New York vs. J.A. Weitzman, Inc., d/b/a/ W&W Manufacturing Company, and individuals Jeffrey A. Weitzman and Muriel Weitzman. Ms. Morales worked for Defendants as a manual laborer at their battery manufacturing and assembly facility for over twelve years. Ms. Morales alleges that she worked a minimum of sixty-one hours and twenty minutes per week, but Defendants did not pay her at all for any hours she worked over forty hours per week, did not pay her the statutorily required overtime rate of pay, or provide her with accurate wage statements in violation of the New York Labor Law, New York Compensation Codes Rules and Regulations and the Federal Fair Labor Standards Act.
