New Collective Action filed vs. OTG Management Inc., et al

Premnarine Narain v. OTG Management Inc., and OTG Management JFK, LLC, and OTG Management T8 LLC., Case No. 15-cv-952

On February 24, 2015, Lead Plaintiff Premnarine Narain on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – Eastern District of New York vs. OTG Management Inc., and OTG Management JFK, LLC, and OTG Management T8 LLC.  Mr. Narain worked for Defendants, a food service company that owns restaurants at various airports throughout the United States such as John F. Kennedy Airport from July 7, 2010 through July 24, 2014.  Mr. Narain alleges Defendants misclassified him as a “Manager” exempt from overtime pay even though he did not have any supervisory authority.  He alleges that he worked between fifty and sixty-five hours per week throughout his employment and Defendants failed to pay him the proper minimum wage for the first forty hours he worked per week, and Defendants failed to pay him at any rate of pay or the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that he worked per week over forty hours per week as the New York Labor Law, and the Federal Fair Labor Standards Act require.  In addition, Defendants failed to furnish Mr. Narain with accurate wage statements on each payday or with proper wage notices at the time or hire or on an annual basis as required by the New York Labor Law.
