On February 20, 2017 Jermaine Hopkins on behalf of himself, individually, and on behalf of all others similarly-situated, filed a class and collective action lawsuit in United States District Court – Eastern District of New York against R&Q Foods, Inc., and Mian Rauf. The complaint alleges and describes that the plaintiff worked at R&Q Foods as a delivery driver. From the beginning of his employment in June 2011 to the end in April 2016, the defendants asked Mr. Hopkins to work, and he did work sixty to sixty-nine hours per week. During this time the defendant failed to pay plaintiff and other employees minimum wage much less the applicable overtime rate for any hours over forty per week, which would violate the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act.
