On May 2, 2016 Lead Plaintiff Keith R. Taylor on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – Eastern District of New York vs. Western Beef Retail, Inc., d/b/a Western Beef and Cactus Holdings, Inc. d/b/a Western Beef, and Peter Castellana III, and Timothy Kellar. As alleged in the complaint, Mr. Taylor worked for Defendants’ grocery store as a “Frozen Manager” from July 2006 until November 2015. Throughout his employment, Defendants willfully misclassified Plaintiff as an exempt employee and failed to pay Plaintiff the wages lawfully due to him under the Federal Fair Labor Standards Act and the New York Labor Law. For the entirety of his employment, Defendants required Plaintiff to work more than forty hours in a workweek, and failed to compensate him at any rate of pay as the New York Labor Law and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Mr. Taylor with accurate wage statements on each payday, as required by the New York Labor Law.
