Firm Secures Judgment in the amount of $100,000.00 – Wage & Hour Violations

Guaman et al. v. Energy Plus NY Corp , et al. Docket No: 1:22-cv-07401

Firm represented a small group of former employees against Energy Plus NY Corp d/b/a Energy Plus, and Energy Plus NY Inc d/b/a Energy Plus, and Moshe Lefkowitz, individually, and Abraham Lichtenstadter, individually, for unpaid overtime wages in violation of the Fair Labor Standards Act and the New York Labor Law.  Generally, the Plaintiffs contended that the Company subjected them to working in excess of forty hours a week each week, yet Defendants failed to pay Plaintiffs at the statutorily-required overtime rate of one and one-half times their regular rate for those hours, and instead paid Plaintiffs on an hourly basis at their regular rate of pay for all hours worked.   Furthermore, Defendants violated the NYLL by: failing to provide Plaintiffs with any wage of notice upon his hire, let alone an accurate one, or with an accurate wage statement on each payday.  After filing a complaint in the United States District Court for the Eastern District of New York, the Firm negotiated a settlement $100,000.00.  Michael J. Borrelli handled the matter on behalf of the firm.
