Firm Secures Judgment in the amount of $150,000.00 – Wage & Hour Violations – Firm represented a collective group of former employees against Joyeria Elizabeth I, Corp., and Joyeria Elizabeth II, Corp., and Joyeria Elizabeth III, Corp., and Joyeria Elizabeth IV, Corp., and Tomasa Izaquirre, individually, and Michelle Izaquirre, individually, for unpaid overtime wages in violation of the Fair Labor Standards Act and the New York Labor Law. Generally, the Plaintiffs contended that the Company subjected them to work more than forty hours in a workweek, however, Defendants paid Plaintiff on an hourly basis at their regular rate of pay for all hours, including those hours that they’ve worked in a week excess of forty, and thus did not pay them at the overtime rate of one and one-half times their regular rate for any hours they’ve worked over forty in a week. Additionally, Defendants further violated the NYLL by failing to provide Plaintiffs with any wage statement on each payday, let alone a statement that accurately listed, inter alia, their actual hours worked and their overtime rates and overtime wages owed. After engaging in mediation, the Firm negotiated a settlement $150,000.00. Michael J. Borrelli handled the matter on behalf of the firm.
