New Collective Action filed vs. Yellowstone Properties, Inc., et al.

Hector O. Santos v. Yellowstone Properties, Inc., and Arthur Green, Orlando Franco, Andy “Doe”, and Edgar Roman, Case No. 15-cv-03986

On May 27, 2015, Lead Plaintiff Hector O. Santos on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – Southern District of New York vs. Yellowstone Properties, Inc. and its president Arthur Green as well as Orlando Franco, Andy “Doe” and Edgar Roman. Mr. Santos worked for Defendant, a housing management company that manages several buildings as a superintendent from November 7, 2013 through September 11, 2014. He alleges that he worked around fifty-four and sixty hours per week throughout his employment. However, Defendants failed to pay Mr. Santos the proper minimum wage, or at any rate of pay, or the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that he worked per week over forty hours per week, as the law requires. In addition, Defendants failed to furnish Mr. Santos with accurate wage statements on each payday, or with proper wage notice at the time of hire, both as required by the New York Labor Law.

To make matters substantially worse, Defendants engaged in egregious and repulsive gender discrimination and sexual harassment of Mr. Santos by denying him the ability to work in a condition free of harassment in violation of Title VII and the New York City Human Rights Law. Further, Defendants retaliated against Mr. Santos by terminating his employment after he complained about this discrimination and harassment, also in violation of Title VII and the New York City Human Rights Law.
