On April 28, 2014, Lead Plaintiff Patrick Mitchel on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – Eastern District of New York vs. his former employers, Fortress FS, LLC and Thomas Forde. Mr. Mitchel is the building superintendent and maintenance employee for two apartment buildings located at 1402 and 1408 Sterling Place in Brooklyn, New York. He alleges that he was required to be available twenty-four hours per day, seven days a week, but he was only paid for the first forty hours of work and not paid the proper minimum wages or overtime wages in violation of New York Labor Law, New York Compensation Codes Rules and Regulations and the Federal Fair Labor Standards Act.
