New Collective Action filed vs. POS Solutions NJ LLC and Glen Gray

Boris Medina v. POS Solutions NJ LLC and Glen Gray, Case No: 15-CV-5369 (VEC)

On July 10, 2015 Lead Plaintiff Boris Medina on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – Southern District of New York vs. POS Solutions NJ LLC and Glen Gray. Mr. Medina worked for Defendants, a technology service company that provides technological support to its client throughout New York and New Jersey. Plaintiff worked for Defendants as a technician with duties that required him to travel to customer locations throughout New York and New Jersey from December 2010 through May 15, 2015. Mr. Medina alleges that he worked between forty one and fifty two hours, five to six days a week throughout his employment. However, Defendants failed to pay Mr. Medina for any hours worked after forty at any rate of pay or the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that he worked per week over forty hours as the New York Labor Law, New Jersey Wage and Hour Law and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Mr. Medina with accurate wage statements on each payday, or with proper wage notices at the time of hire or on an annual basis as required by the New York Labor Law.
