Esther Jackson-Spenser v. Pamela McKenzie, Case No. 14-cv-4985

On August 13, 2014, Lead Plaintiff Esther Jackson-Spenser on behalf of herself and those similarly situated filed a collective action lawsuit in United States District Court – Eastern District of New York vs. Pamela McKenzie a/k/a/ Pamela McKenzie Cummings. Ms. Jackson-Spenser performed sales clerk duties for Defendant, the owner of a business that holds itself out to the public as “Pam’s Bakery & Cake Decorating,” for nearly eleven years. Ms. Jackson-Spenser alleges that she worked between forty-one and one-half and forty-five hours per week, but Defendant paid her a flat wage covering the first forty hours, in cash, regardless of how many hours she worked each week. Ms. Jackson-Spenser further alleges that Defendant did not compensate her at any rate of pay, let alone the minimum wage or overtime rate of pay, for any hours that she worked each week in excess of forty, in violation of the New York Labor Law, New York Compensation Codes Rules and Regulations and the Federal Fair Labor Standards Act.
