On July 30, 2014, Lead Plaintiffs Khalid Elfoulki and Ketevan Chichinadze, on behalf of themselves and those similarly situated filed a class and collective action lawsuit in United States District Court – Southern District of New York vs. Brannon’s Sandwich Shop, LLC, d/b/a Brannon’s and Anemacore, LLC, d/b/a Donatella’s, Ronald Brannon and Donatella Arpaia. Plaintiffs worked for Defendants as servers and bartenders. Plaintiffs allege that they worked between twenty and forty hours and twenty-five to forty hours per week, respectively. Defendants paid Plaintiffs $5.00 per hour alleging a tip credit, but did not inform the Plaintiffs in writing or otherwise that they intended to claim a credit, they did not provide accurate wage statements to Plaintiffs, they did not provide tips to employees on time, and Defendants utilized an impermissible tip pool wherein Plaintiffs were required to share tips with Defendants in violation of New York Labor Law and the Federal Fair Labor Standards Act.
