New Action filed in the United States District Court Southern District of New York

On October 29, 2024, Plaintiff Nance, by and through her attorneys, BORRELLI & ASSOCIATES, P.L.L.C., as and for Complaint against THE CITY OF NEW YORK (“Defendant” or “City”), alleges upon knowledge as to herself and her own actions, and upon information and belief as to all other matter, as follows:

Plaintiff , a Black female Christian who was 45 years old when the discrimination and harassment began and 48 at the time of her retirement, worked for Defendant – – The City of New York – – in various positions at the New York City Department of Corrections from November 14, 1996 until she retired on January 1, 2020. Plaintiff brings this action to seek redress for Defendant’s discrimination, harassment and retaliation against her during her employment – – the impacts of which she is still suffering from in retirement – – on the basis of race, sex, religion and age, as well as retaliation for engaging in protected activity. Specifically, as detailed herein, Defendant discriminated against Plaintiff due to her race and/or sex and/or religion and/or age by subjecting her to a hostile work environment, refusing to accommodate her religious beliefs, and retaliating against her for refusing the sexual advances of a superior and for complaining about said discrimination by significantly reducing her ability to earn overtime, in violation of Title VII, Age Discrimination in Employment Act (“ADEA”), New York State Human Rights Law (“NYSHRL”), and New York City Human Rights Law (“NYCHRL”).
