On May 13, 2014, Lead Plaintiff Natalie Wells on behalf of herself and those similarly situated filed a class and collective action lawsuit in United States District Court – Southern District of New York vs. Hilda Demirjian Laser & Spa, LLC, Hilda Demirjian, and Nicole Sprague. Ms. Wells worked as a massage therapist at Hilda Demirjian Laser & Spa, and her primary source of compensation was in the form of tips. Ms. Wells alleges that the Defendants allowed manager Ms. Sprague to keep a significant portion of tips for herself even though the tips were left for non-managerial employees such as Ms. Wells. Additionally, she alleges that Defendants never notified her that Defendants would be crediting Plaintiff’s tips to their hourly wage, there were often times that she was paid less than the minimum wage and she never received any accurate wage statements. Additionally, when Ms. Wells complained to them about their pay practices, they unlawfully retaliated against her by firing her. In sum, Ms. Wells alleges that Defendants’ pay practices and retaliation violates the New York Labor Law, New York State Department of Labor’s Hospitality Industry Wage Order, New York common law, and the Federal Fair Labor Standards Act.
