 On September 28, 2022, Plaintiff Amondi, by and through her attorneys, BORRELLI & ASSOCIATES, P.L.L.C., as and for her Complaint PROMISE HOME CARE AGENC, INC. (“Promise Home Care”), and GODFREY ECHENDU, individually, (“Echendu”), (collectively, where appropriate, as “Defendants”), alleges upon knowledge as to herself and her own actions and upon information and belief as to all other matters as follows:

Plaintiff worked for Defendants – – a corporation that provides health care services to families with disabled persons and its Principal, who was Plaintiff’s direct supervisor – – as a Licensed Practical Nurse (“LPN”), from December 2015 until October 2019. Throughout Plaintiff’s employment, Echendu subjected Plaintiff to egregious sexual harassment, which included multiple sexual assaults, in violation of the Victims of Gender-Motivated Violence Protection Act (“VGMVPA”) and the Civil Rights Law (“CRL”).  Furthermore, Defendants, through Echendu’s behavior, specifically conditioned Plaintiff’s receipt of increased working hours on her acquiescence to his sexual attacks, which Plaintiff did not welcome, and which thus constitutes both quid pro quo and hostile work environment sexual harassment in violation of the New York Civil Rights Law (“NYCHRL”). Lastly, after Plaintiff joined a federal lawsuit seeking compensation from Defendant Promise Home Care for, inter alia, unpaid overtime wages under the Fair Labor Standards Act (“FLSA”), Defendants retaliated by cutting Plaintiff’s hours to the point where Plaintiff could not financially afford to continue working for Defendants, thereby terminating her employment. https://www.employmentlawyernewyork.com/news/latest/1100000-wage-hour-violations.html
