Angel and Angel v. Wei Hui Lin a/k/a Steven Lin, individually, and Brenda Ong a/k/a Brenda Lin, individually, Index No.: BUR-L-001906-22

 On October 7, 2022, Plaintiffs ANGEL and, ANGEL (together as “Plaintiffs”), by and through their attorneys, BORRELLI & ASSOCIATES, P.L.L.C., as and for their Complaint against WEI HUI LIN a/k/a STEVEN LIN, individually, and BRENDA ONG a/k/a BRENDA LIN, individually, (collectively as “Defendants”), alleges upon knowledge as to themselves and their own actions and belief as to all other matters, as follows:

Plaintiff An. Angel worked for Defendants – – the owners/day-to-day overseers of a Burlington County restaurant that continuously changes its corporate and doing business as name to evade creditors and avoid liability – – as a non-managerial kitchen staff employee, from mid-March 2016 through October 24, 2019.  Plaintiff Ad. Angel worked for Defendants from October 2018 through October 24, 2019, in that same role.  Throughout Plaintiff’s employment, Defendants failed to pay Plaintiffs the wages lawfully due to them under the New Jersey Wage and Hour Law (“NJWHL”) and the New Jersey Wage Payment Law (“NJWPL”).  Specifically, throughout Plaintiff’s employment, Defendants required Plaintiffs to work, and Plaintiffs worked beyond forty hours in a workweek, while paying Plaintiffs a flat weekly salary that fell below New Jersey’s minimum wage rate for all hours worked and that did not include overtime premiums of at least one and one-half times the minimum wage rate for all hours that Plaintiffs worked per week more than forty.  Additionally, Defendants failed to pay Plaintiffs the full amount of their wages owed on each payday, in violation of the NJWPL.
