On November 5, 2014, Lead Plaintiff Laura Indelicato on behalf of herself and those similarly situated filed a collective action lawsuit in United States District Court – Eastern District of New York vs. Catholic Health System of Long Island, Inc., d/b/a/ Catholic Health Services of Long Island. From July 29, 2013 to the present, Defendant employed Ms. Indelicato as a dietary “supervisor” at Defendant’s Good Samaritan location. Though she held the position of dietary “supervisor,” Ms. Indelicato alleges that she was no more than a glorified babysitter for Good Samaritan’s kitchen staff, mainly tasked with expediting the food served to patients and dealing with patients’ complaints. In addition, she worked over forty hours per week practically every week throughout her employment with Defendant, but the Defendant did not pay her at all for any hours she worked over forty hours per week, did not pay her the statutorily required overtime rate of pay, or provide her with accurate wage statements in violation of the federal Fair Labor Standards Act, New York Labor Law, and New York Compensation Codes Rules and Regulations.
