New Collective Action filed in the Eastern District of New York

Calderon v. Dynamic Corporate Holdings, Inc., et al., Case No. 2:14-cv-03093

On May 16, 2014, Lead Plaintiff Michael Calderon on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court - Eastern District of New York vs. his former employers, a chain of cellular telephone stores, Dynamic Corporate Holdings, Inc., Front Page Inc., Butler Realty Corp., Rockville Centre Wireless Inc. Riverhead Wireless Corp., Long Beach Wireless, Inc., Bay Shore Wireless, Inc., and individual store owners, Mark Butler, Tony Saracini, Mitchell Penn, and John Cruz.  In his complaint, Mr. Calderon alleges that his employers gave him a job title of “Store Manager” so that it seemed like he held a management role and would therefore be exempt from overtime.  However, Mr. Calderon argues that he never held any managerial responsibilities and is therefore wrongly classified and entitled to overtime.  Mr. Calderon alleges his actual job position was that of a customer service representative, and he worked approximately fifty hours per week but did not get paid overtime wages or any amount of pay for hours he worked over forty hours per week in violation of New York Labor Law, New York Compensation Codes Rules and Regulations and the Federal Fair Labor Standards Act.  If any person worked for any of the companies or individuals named as a Defendant in the lawsuit during the time period of May 16, 2008 – May 16, 2014, or has information that may be relevant to this case, contact Borrelli & Associates, P.L.L.C. as soon as possible through our website, or any of our phone numbers: (516) 248 - 5550, (516) ABOGADO, and (212) 679 - 5000.
