On June 17, 2016, Lead Plaintiff Ines Cabrera, on behalf of herself and those similarly situated, filed a class and collective action lawsuit in United States District Court – Eastern District of New York vs. Christopher Stephens d/b/a 7-Eleven, and Attaullah Khan. The complaint alleges as follows: Ms. Cabrera began working for Defendants as an hourly employee from October 1, 2010 through October 24, 2013. Throughout each week of her employment, Defendants required Plaintiff to work, and Plaintiff in fact did work, in excess of forty hours. Defendants adjusted Plaintiffs hours worked each week to avoid paying her for the majority of her overtime hours worked. During her employment, Defendants failed to pay Plaintiff the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that she worked per week over forty hours as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act requires. In addition, Defendants failed to provide Plaintiff with the appropriate wage statements as required by the New York Labor Law.
