On January 19, 2016, Lead Plaintiff Yunior Aquino, on behalf of himself and those similarly situated, filed a class and collective action lawsuit in United States District Court – Southern District of New York vs. Fort Washington Auto Body Corp., and Thomas Surdak. The complaint alleges as follows: Mr. Aquino began working for Defendants around April 2007 to September 18, 2015 as a painter. Throughout his employment, Defendants required Plaintiff to work, and Plaintiff did in fact work, in excess of forty hours each week. During his employment, Defendants failed to pay Plaintiff the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that he worked per week over forty hours as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Mr. Aquino with accurate wage statements on each payday.
