On August 12, 2016, Lead Plaintiff Elizabeth Islam on behalf of herself and those similarly situated filed a class and collective action lawsuit in the United States District Court—Southern District of New York vs. 7th Avenue Gifts LLC, John Doe Corporations 1-10, and Jahagir Afzal. Ms. Isalm worked in a three New York City gift shops owned by the defendant, selling merchandise to out- of-state tourists. Her primary duties consisted of organizing inventory, replenishing merchandise on the store’s shelves, cleaning the premises, retrieving merchandise from the back storage area, and interacting with customers. Ms. Islam alleges that while she often worked far in excess of forty hours per week, the defendant did not compensate her for any hour worked above the first forty, let alone at the proper overtime compensation at the statutorily-required overtime rate of pay as required by the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act. Additionally the defendant did not permit Ms. Islam to take scheduled or uninterrupted breaks during twelve-hour shifts.
