On November 7, 2016 Edwin Ramos on behalf of himself, individually, and on behalf of all others similarly-situated, filed a class and collective action lawsuit in United States District Court – Southern District of New York against Parkchester Preservation Management LLC. Mr. Ramos was employed by Parkchester residential complex as a security officer. His responsibilities included patrolling the Parkchester complex, making arrests, issuing citations, and enforcing the New York State Penal Law with the same weight and authority as the New York City Police Department. The complaint alleges that the defendants regularly asked all security personnel to arrive to work early and stay late to complete paper work, often pushing the hours worked per week over 40. However, they refused to pay the security personnel for this time spent completing paper work. In all other instances during which Mr. Ramos or other security personnel worked over 40 hours per week, the defendants did not compensate them at all, let alone at the minimum and previously agreed to overtime rate per New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act.
