On January 26, 2017, Lead Plaintiff Luis Cabrera, on behalf of himself and those similarly situated, filed a class and collective action lawsuit in United States District Court – Eastern District of New York vs. Carpetorium, Inc., and Hamid Elayni. The complaint alleges as follows: Mr. Cabrera began working for Defendants, an interior renovations company, around February 2008 to February 2016 as a manual laborer. During his employment, Plaintiff was required to work over forty hours each week, but Defendants failed to pay Plaintiff the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that he worked per week over forty hours as the New York Labor Law, and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Mr. Cabrera with an accurate wage statements on each payday.
