On May 25, 2016, Lead Plaintiff Mr. Williams, on behalf of himself and those similarly situated, filed a class and collective action lawsuit in United States District Court – Southern District of New York vs. Fairfield Family Care, LLC and Fairfield Family Care Holdings, LLC and Gary Ferone. The complaint alleges as follows: Mr. Williams began working for Defendants, a home care staffing agency, around July 2014 to December 2015 as a caregiver. Plaintiff worked throughout his entire employment over forty hours each week. Defendants failed to pay Plaintiff the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that he worked per week over forty hours as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act requires. In addition, Defendants failed to furnish Mr. Williams with accurate wage statements and wage notices on each payday.
