Glen Bernard v. PSCH, Inc., et al., Case No. 14-cv-5008

On August 18, 2014, Lead Plaintiff Glen Bernard on behalf of himself and those similarly situated filed a collective action lawsuit in United States District Court – Eastern District of New York vs. PSCH, Inc., d/b/a/ Promoting Specialized Care and Health, and individuals Charlene Densen and Andrew Carbonara. Mr. Bernard worked for Defendants with the title of auto technician, performing various duties such as fixing and inspecting vehicles that the Defendants used and maintaining the Defendants’ garage and property. Mr. Bernard alleges that he often worked in excess of forty hours per week and was required to be “on-call” twenty-four hours a day during the third week of every month, but Defendants did not pay him at all for any hours he worked over forty hours per week, did not pay him the statutorily required overtime rate of pay, or provide him with accurate wage statements in violation of the New York Labor Law, New York Compensation Codes Rules and Regulations and the Federal Fair Labor Standards Act.
