On June 24, 2014, Lead Plaintiff Jesus Rivera on behalf of himself and those similarly situated filed a class and collective action in United States District Court - Eastern District of New York vs. Showroom Condition Detailing, Inc. and Joseph Caiozzo. Plaintiff worked for Defendants as a general laborer who washed and detailed automobiles. Plaintiff alleges he worked seven days per week in shifts which varied from eight to eleven hours per day for a total of sixty-six-and-one-half hours per week, but Defendants did not pay him at any rate of pay for hours he worked over forty hours per week, did not pay him the statutorily required overtime rate of pay for hours he worked over forty hours per week, and did not provide him with accurate wage statements in violation of New York Labor Law, New York Compensation Codes Rules and Regulations and the Federal Fair Labor Standards Act.
