On July 21, 2014, Lead Plaintiff Jose Manuel Martinez-Rivera on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – District of New Jersey vs. Chung Sol Garden Corporation, d/b/a Chung Sol Bat Restaurant, Joon Kim and Nan Kim. Mr. Martinez-Rivera worked for Defendants as a cook and dishwasher from December 2013 through May 2014. He alleges that he worked six days a week in twelve hour shifts for approximately seventy-two hours per week. However, Defendants paid him in cash, did not pay Mr. Martinez-River the proper minimum wages, did not pay any wages or the required time-and-a-half for each hour worked per week in excess of forty hours in violation of the New Jersey Wage and Hour Law and Federal Fair Labor Standards Act. Additionally, Mr. Martinez-Rivera alleges that when he took two weeks off for a serious hand injury, Defendants reduced his pay and forced him out of his job because he could no longer support himself in violation of the New Jersey Law Against Discrimination.
