Josue Vega v. Trinity Realty Corp., et al., Case No. 14-cv-7417

On September 12, 2014, Lead Plaintiff Josue Vega on behalf of himself and those similarly situated filed a collective action lawsuit in United States District Court – Southern District of New York vs. Trinity Realty Corp., Joseph Phan and Philip Phan. Mr. Vega worked for Defendants as a superintendent and/or laborer performing maintenance work and repairs in Defendants’ buildings from September 2012 until his termination in December 2013. Mr. Vega alleges that Defendants required him to be available twenty-four hours a day, seven days a week, but failed to pay him at the overtime rate of pay of one and one-half times the minimum wage rate for each hour that he worked per week in excess of forty, as the New York Labor Law, New York Compensation Codes Rules and Regulations and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Mr. Vega with accurate wage statements on each payday.
