On December 3, 2014, Lead Plaintiff Kanwarpreet Thind on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – Southern District of New York vs. Healthfirst, HF Management Services, LLC d/b/a Healthfairst, and Healthfirst PHSP, Inc. d/b/a Healthfirst. Mr. Thind worked for Defendants as a “Facilitated Enroller” from August 2009 through January 2012, and as “Manager for Sales” from January 2012 through August 2014. He alleges that he worked over forty hours per week throughout his employment in both positions. However, when he worked as “Facilitated Enroller,” he was not paid overtime and when he worked as “Manager for Sales,” his company misclassified him as an “exempt” employee and did not pay him overtime, though he did not have “exempt” duties and should have been entitled to overtime pay. Thus, Mr. Thind alleges that Defendants failed to pay him the proper minimum wage and the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that he worked per week over forty hours per week as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Mr. Thind with accurate wage statements on each payday and wage notices at the time of hire and/or on an annual basis as required by the New York Labor Law.
