On October 10, 2014, Lead Plaintiff Otilio Rivera on behalf of himself and those similarly situated filed a collective action lawsuit in United States District Court – Eastern District of New York vs. H & F Athletics, Inc., d/b/a Carefree Racquet Club, and individuals George Haber and Alan Fischl. Mr. Rivera worked for Defendants from 2003 until September 8, 2014, performing duties such as cleaning Defendants’ building, removing garbage, shoveling snow and setting up for parties hosted at Defendants’ facility. Throughout his employment, Defendants required Mr. Rivera to work between forty-six and fifty-three and one-half hours per week. However, Defendants failed to pay Mr. Rivera overtime compensation at the statutorily-required overtime rate of pay for each hour that he worked per week that was in excess of forty total hours, as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Mr. Rivera with accurate wage statements on each payday as required by the New York Labor Law.
