On May 30, 2014, Lead Plaintiff Ramon Collado on behalf of himself and all others similarly situated filed a class and collective action lawsuit in United States District Court – Southern District of New York vs. DonnyCarney Restaurant LLC d/b/a/ O’Casey’s, Clonmel Restaurant Corp. d/b/a Desmond’s Steak House and Grill, Connemaria Restaurant Corp. d/b/a Kennedy’s and/or Desmond’s, Pier 45 Rest. Inc. d/b/a Hudson River Park Café, GBL Restaurant Corp. d/b/a/ Kennedy’s, and Paul Desmond Hurley. Defendants employed Plaintiff as a “promoter,” who distributed flyers to pedestrians on the streets of Manhattan. Mr. Collado alleges he worked fifty hours per week, six days per week with shifts between eight to ten hours per daybut Defendants did not pay him at all for any hours he worked over forty hours per week, did not pay him the statutorily required overtime rate of pay, or provide him with accurate wage statements in violation of New York Labor Law, New York Compensation Codes Rules and Regulations and the Federal Fair Labor Standards Act.
