On May 6, 2014, Lead Plaintiff Ricardo Agosto on behalf of himself and those similarly situated filed a collective action lawsuit in United States District Court - Eastern District of New York vs. his former employers, 15-21 Crooke, LLC and Abe Kahan. Mr. Agosto worked as the building superintendent and maintenance employee for the apartment building located at 15 Crooke Avenue in Brooklyn, New York. He alleges that during his ten-year employ, he was required to be available twenty-four hours per day, seven days a week, but he was only paid for the first forty hours of work and was not paid the proper minimum wages or overtime wages in violation of New York Labor Law, New York Compensation Codes Rules and Regulations and the Federal Fair Labor Standards Act.
